CHARGES: EXTREME DUI (1st Offense)

Definition

BAC of .15 or more within two hours of driving

Possible Sentence

  1. Mandatory minimum of 30 days in jail (20 days may be suspended by Judge if you successfully complete alcohol screening) 10 days must be served consecutively but work release may be available. (The first 48 hours must be served consecutively.)
  2. Fine of approximately $1,725.00. License suspension for 90 days. Can be modified to 30 days suspended plus 60 days restricted driving (work/school). License suspension may involve separate hearing at DMV. This hearing must be requested in writing within 15 days of arrest. If you refuse to take the type of test requested by the officer, your driver’s license is automatically suspended for 1 year. Alcohol Screening. One hour meeting with alcohol counselor who may recommend counseling and/or alcohol education.
  3. Ignition interlock system required in vehicle for 1 year following suspension.
