DUI (Second Offense) - Misdemeanor

Definition:

A second conviction for DUI within a five (5) year period.

Possible Sentence:

  1. Mandatory jail sentence: 90 days. Sixty (60) days of this sentence can be and usually are suspended by the Judge if you successfully complete alcohol screening.
  2. Fine of approximately $850.00.
  3. License is revoked or cancelled for one (1) year. License cancellation may be handled separately by DMV. A hearing may have to be requested within fifteen (15) days of arrest to avoid an additional 90 day suspension. In addition, after license is reinstated, ignition interlock system required in vehicle for 1 year.
  4. Alcohol Screening. One hour meeting with alcohol counselor who may recommend counseling, education or treatment.

Options:

  1. Jury Trial
  2. Plea to minimum sentence as outlined above.
  3. Plea to minimum sentence.
    -24 hours in jail
    -Fine of approximately $450.00

    -License Suspension (if not already suspended by MVD)
